Our Process
Every mediation follows a structured, confidential process designed to maximize the probability of resolution. Gregory retains full discretion to adapt the framework to the specific needs of each matter.
Execute the Mediation Agreement and submit payment as outlined in the engagement agreement. Each party provides a confidential mediation brief at least three business days before the session, including a summary of the dispute, key issues, interests, and relevant documents.
Gregory opens the session by explaining the process, ground rules, and his role as a neutral facilitator. Each party receives an uninterrupted opportunity to present an opening statement, and settlement authority of all parties is confirmed.
Gregory meets separately with each party in confidential caucuses. Everything shared is protected. These sessions allow for frank discussion, reality-testing, and exploration of settlement options in a secure environment without disclosure to the opposing side.
Gregory acts as a neutral communication channel, conveying offers and information between parties. He helps each side understand the other's position, identifies underlying interests, and generates creative solutions. If impasse is reached, he may offer a neutral evaluation or submit a Mediator's Proposal.
If a settlement is reached, parties draft a written settlement agreement reflecting the agreed terms. That agreement becomes a binding contract upon execution. If the matter does not resolve, all discussions remain confidential, and parties retain all legal rights and remedies.
This guide describes a typical mediation process and does not create binding procedural obligations. The Mediator retains full discretion to adapt the process as necessary to effectively facilitate resolution.
Engagement
Sessions are reserved upon receipt of payment in full and full execution of all required agreements. Please review the following acknowledgments before booking your session.
